The police officer committed both a constitutional and common law tort. In other words, he used the color of law to violate the civil rights of these citizens.
In trying to enforce a non-existent law he violated their rights under the first and fourteenth amendments, which is also a violation of the 1871 civil rights act.
What does all that mean? It means that the officer is personably liable and can be sued. He is no longer immune. The city is also liable and possibly the security guard.
If I were thedm, I would sue the living crap out of all them in the most public way possible.

We have received an excellent response thus far to this counter-protest in Denver. We are expecting a very nice turnout of Tea Partiers and 9-12 members alike. Let us not forget that we protest different than the Left does. We are respectful, peaceful, well-informed people.

I tried to attend a number of McCain/Palen rallys when Palin was in Florida. I had anti McCain/Palen placards. As a result they would not let me into the rally and required me to stand away from people entering the rally and not to bother them.
Ms Nason was obviously there to agitate the people standing in line at the forum. She was challenging them about why they were there and why they were supporting healthcare reform.
It appeared to me that the officer was trying to keep down possible conflict just as the line stewards were at the McCain/Palen rallys.
People have a right to stand in line without being harrassed by someone like Ms Nason or me. I certainly didn’t expect to be able to confront the people at the rally and I don’t think Ms Nason should have that right either.

We ESPECIALLY are aware, have been trained to recognize, and trained to protect speech with which we disagree, which may not be popular, and we put our lives on the line so that they can do it despite how it looks to others. We’re not the “mindless thugs” that some people think.
